Treats Rewards: Terms & Conditions

Subject to the terms and conditions set forth below, members ("Members" or “you” or “your”) of this Treats Rewards program ("Treats" or “Treats Rewards” or the "Program" or the "Treats Rewards Program") will earn points in connection with the purchase of qualifying products and services at PetSmart stores, on PetSmart.ca, on the PetSmart App or via any other method PetSmart provides, which they may use for savings at PetSmart.
By joining the Treats Rewards Program, you agree to be bound by these terms and conditions. PetSmart reserves the right to terminate, cancel, modify, or restrict Treats or any aspect of the Program, including, without limitation, these terms, the point conversion ratio and the point expiration policy, at any time. PetSmart may make changes to the Program even if such changes affect your ability to use points already accumulated. Changes can be made without advance notice.
I. MEMBERSHIP
1. Membership and Eligibility.
The Treats Rewards Program is a free loyalty program offered by PetSmart. You must be 18 years or older and a resident of Canada to be eligible for membership. Membership in the Program is limited to individuals only and is limited to one account per individual email address.
2. Membership Tiers.
There are three tiers of membership in the Program: Member, Bestie and Very Important Pet Parent (VIPP). When you join, you will automatically be placed in the Member tier and be eligible for all the benefits thereto. Achieving Bestie- or VIPP-tier status requires a minimum spend per year on qualifying products and services, as explained below and in the Treats FAQs. PetSmart reserves the right to confer tier status based on conditions other than spend (e.g., employment status, promotional) at its discretion. Tier status is valid for the balance of the calendar year in which the Member qualifies for it, as well as the following calendar year.
All membership tiers enjoy a variety of benefits made available by PetSmart in its sole discretion from time to time. Benefits may vary by tier and some tiers may have more benefits than others. The type, timing and availability of any benefits (including tier bonus points, special offers, sweepstakes, appreciation events, etc.) will be determined by PetSmart in its sole discretion. Details about the benefits can be found in the Treats FAQs or in other applicable promotional communications. PetSmart may, in its sole discretion, alter, limit, or modify the tier rules, benefits, eligibility for membership, or any other feature of a particular tier or may terminate a particular tier at any time in its sole discretion, without prior notice except as required by applicable law.
3. Membership Tier Minimum Spend.
The full details regarding the minimum spend for tiers is included in the Treats FAQs. Certain purchases, like gift cards will not be counted toward the annual minimum spend. All purchases made: (i) by a Member prior to such member joining the Program, (ii) without identifying themselves as a member of the Program, (iii) Online without a Member being logged into the Website, (iv) at an affiliated veterinarian’s office, or (v) on a third party delivery marketplace (unless your Treats account is linked to such marketplace), are not eligible toward a Member’s minimum spend. All returns, refunds, amounts from returned checks, or other credits will be deducted from the annual minimum spend.
4. Enrollment.
There is no cost to join Treats Rewards. Members receive a Treats Rewards account number that is unique to such Member ("Account") after providing enrollment details (first name, last name, email address, and phone number) via the following methods (or any other method PetSmart permits):
A.) In-Stores. You may enroll in the Program when you visit any PetSmart store. In order to enroll in store, you will need to provide relevant information (e.g., phone, email) to the PetSmart cashier.
B.) Online. You may enroll in the Program by visiting www.petsmart.com (the “Website” or “Online”). In order to enroll on the Website, you must register to be a user of the Website and have an email/username and password.
C.) Mobile. You may enroll in the Program by downloading and accessing the PetSmart App (the “Mobile App”). In order to enroll on the Mobile App, you must register to be a user of the Mobile App and have an email/username and password.
Members may be required to provide proof of identity and/or proof of age during participation or enrollment in the Treats Rewards Program.
U.S. residents should enroll through a PetSmart channel (store, online or mobile) in their Program jurisdiction. PetSmart reserves the right to convert any Treats account to the appropriate Program based on enrollee’s address.
5. Membership Account.
If you believe there is an error in your Account balance or that your Account has been the subject of any suspicious activity, immediately contact PetSmart Customer Care at 1-888-839-9638. Accounts are not transferable and are not for sale, resale or barter. PetSmart is not responsible for use of a Member's Account or redemption of a Member's points in the event the Member's Account is stolen and the Account is used or the points are redeemed prior to the Member informing PetSmart that the Member's Account has been stolen. PetSmart will not be responsible for reinstating points lost due to theft. PetSmart may revoke any membership in Treats Rewards at any time if it suspects such Member of engaging in abuse of the Program or failing to follow the rules of the Program. Fraud or abuse relating to the accrual of points or redemption of treats will result in revocation of membership in the Program and will affect a Member's eligibility for participation in any other PetSmart program. Revocation results in a forfeiture of all points. The interpretation and application of the Program’s rules are at the sole discretion and determination of PetSmart. You are responsible for remaining knowledgeable about the Program rules. A Member's points balance, as reflected in PetSmart’s records, shall be deemed correct. PetSmart reserves the right to determine the amount of points in any Member's account based on PetSmart’s internal records related to such Member's account.
6. Account Management.
Members must keep their personal information on their Account up to date via the Website or the Mobile App, by visiting any PetSmart location or by calling PetSmart customer service. If you are a Member of the Program but not a registered user of the Website or the Mobile App, you may become a registered user of the Website or the Mobile App by creating a profile with the same email address used to enroll in the Program by clicking “Create an Account” and proceeding through the associated registration screens. Once you are a registered user of the Website or Mobile App you will need to validate the email account via an email that will be sent to your registered email. PetSmart may also obtain change of address updates from other sources such as the U.S. Postal Service but is not obligated to do so. The information you provide as a member of the Program will be handled according to PetSmart’s privacy policy. 7. Online Account Management.
Once you are a registered user of the Website or Mobile App, you may view a summary of your Account on the Website or Mobile App. After logging onto the Website or Mobile App, simply click on the "My Account" link in the header of the Website or Mobile App homepage and view or edit information on your Account. You may also view your Treats Rewards points balance and transaction history on the Website of Mobile App by logging in and clicking on the "treats & offers" link in the profile navigation.
8. Member Cancellation.
You may cancel your Treats Rewards Account at any time by contacting PetSmart Customer Care at 1-888-839-9638. Upon cancellation, any unused points accrued in your account will be forfeited and cannot be redeemed.
II. EARNING POINTS
1. General.
Members can earn Treats Rewards points with the purchase of qualifying products and services at PetSmart stores, petsmart.com, petsmart.ca, on the PetSmart App or via any other method PetSmart provides. Members can also earn Treats Rewards points by making cash donations to PetSmart Charities at petsmart.com or petsmart.ca or through the in-store pin-pad at participating PetSmart stores. You must be a registered user of the Website in order to earn Treats Rewards points for Online purchases. You must notify the associate at checkout in stores of your membership to earn Treats Rewards points in store. PetSmart assumes no responsibility for errors caused by incorrect Member information. Points are only a measurement of your participation in the Treats Rewards Program. Use of the word “earn” in marketing materials in relation to points shall mean to collect points as a measurement of participation in the Treats Rewards Program and does not mean that the points have any value. Points are only redeemable for awards as provided for by the Treats Rewards Program and only when combined with the other prerequisites for redemption, including an active Treats Rewards membership. Points may not be transferred by operation of law, such as by inheritance or in bankruptcy.
2. Tier-Based Points.
Under the Program, Members will earn points as set out in the Treats FAQs. All tiers have the same base earn. The tier bonus point amount available for Bestie and VIPP Members is provided only for the underlying purchase amount of the qualifying product or service purchased by a Member and not for any bonus points promotion, multiplier, or any other additional offer, each which will be subject to the base earn of the Member tier.
3. Gift Cards.
When a Member makes a qualifying purchase in stores or Online using a gift card, the Member will earn points on the amount of the purchase.
4. Timing of the Addition of Points to Accounts.
Treats Rewards Points
In-Store Purchases: Treats Rewards points earned on the underlying in-store purchase of qualifying products or services will be added to your Account immediately at the time of in-store purchase of the qualifying products or services. Any other points (bonus points, multipliers, points earned on third party delivery marketplaces or other additional points) may take 72 or more hours to be awarded. For all in-store purchases, the amount of points in your Account, including points earned on your recent purchase, will be reflected on your receipt after a transaction. In the event of system unavailability or other technical difficulty the points will be added upon resolution of the technical challenge. The timing for issuing points is subject to change.
Online Purchases: Treats Rewards points earned on the Online purchase of qualifying products or services will be credited within 24 hours after the entire order for the item has shipped. The timing for issuing points is subject to change.
5. Exclusions.
Treats Rewards points will not be earned for tips and gratuities, shipping and handling charges and all taxes, including without limitation, federal, provincial, and local taxes or use taxes. Treats Rewards points will not be earned on any donations made at petsmartcharities.org. Treats Rewards points will not be earned on any discounts or other credits offered in connection with a product or services. For example, if a product that is normally $100 is on sale for $75, a Member will only earn points on the purchase price of $75. All veterinary services, purchases of gift cards, issuance of store credit, and any type of price adjustments, including merchandise returns, are not eligible for points. All purchases made: (i) by a Member prior to such member joining the Program, (ii) without identifying themselves as a member of the Treats Rewards program, (iii) Online without a Member being logged into the Website, are not eligible for program credit, (iv) at an affiliated veterinarian’s office, or (v) on a third party delivery marketplace without (unless your Treats account is linked to such marketplace).
6. Returns.
Points earned for a purchase that is then the subject of a return, refund, returned cheque due to non-sufficient funds, or other credit will be deducted from the Member's account in an amount equal to the points earned for the original transaction, including bonus points. A return can cause your Treats Rewards account to have a negative point balance. Redemptions made for purchases later returned are not added back to a Member’s account.
7. Marketplaces
PetSmart has relationships with certain third-party delivery marketplaces wherein it may allow Members to link their Treats Reward account to that platform in order to receive points for purchases made at PetSmart on the platform. Points will be provided for purchases made on a platform only if the Member’s account is linked to that platform before the transaction and only for qualifying products.
8. Maximum Points Within a Year
PetSmart reserves the right to implement a maximum number of points that may be earned through the Program in a given calendar year.
9. Bonus Point Promotions.
From time to time, PetSmart may run certain bonus point promotions. Bonus point promotions are subject to the terms and conditions of the offer, may have a shorter expiration period than standard points, and may be offered at any time in PetSmart’s sole discretion. Bonus points will always be awarded at the base point amount regardless of a Member’s Tier.
III. REDEEMING POINTS
1. General.
Treats Rewards points are non-transferable and cannot be redeemed for cash. No credit or cash will be given for unused points, and points are not your property. Points earned by a Member may be redeemed on a first in, first out basis. Points cannot be used to make a donation (except subject to a specific promotion allowing for the donating of points), to pay for taxes, tips, or shipping and handling. The sale of points is prohibited and may result in the forfeiture of your points as well as termination of Membership, which in each case shall be final and conclusive.
2. Points towards Products and Services.
Members can use their points to reduce the purchase price of a product or service. Points must, and may only, be redeemed in increments as specified by PetSmart. Points redeemed may be combined with other discounts and special offers except where terms specify otherwise. Treats points are deducted from the transaction prior to any discount or special offer.
3. Redemption in Stores.
To redeem points towards a purchase at a PetSmart store, Members must indicate that points are being redeemed prior to making the purchase and must identify themselves as members of the Treats Rewards program. To redeem 20,000 or more points at a PetSmart store, Members must verify their identification by showing a driver's license or other government-issued photo identification.
4. Gift Cards.
Points cannot be used towards the purchase of gift cards.
5. Redemption Online.
Members may redeem their points on any purchase of qualifying products made Online. To redeem points towards a purchase Online, a Member must be a registered user of the Website and must be logged in to their Account. Points may be redeemed on the purchase price of qualifying products only and cannot be used towards the payment of sales tax or shipping and handling charges, tips or for the purchase of gift cards.
6. Exclusions.
Points accumulated on different Accounts of different Members may not be combined or aggregated to make purchases of products or for any other reason. Points earned in a transaction cannot be redeemed in the same transaction. Rewards cannot be transferred between accounts. Points cannot be used if purchasing through a third party delivery marketplace or platform.
7. Points Expiration.
Points will be redeemed in the order in which they were earned. INACTIVITY IN THE CANADIAN TREATS REWARDS PROGRAM FOR 12 CONSECUTIVE MONTHS MAKES YOUR POINTS ELIGIBLE FOR EXPIRATION. “ACTIVITY” IS DEFINED AS EARNING OR REDEEMING POINTS. TO THE EXTENT PERMITTED BY LAW, IF THERE IS NO ACTIVITY IN THE 12 MONTHS PRIOR, EACH POINT EXPIRES AT THE END OF THE TWELFTH MONTH FROM THE DATE IT WAS EARNED, AND POINTS ARE ELIGIBLE FOR EXPIRATION EACH MONTH THEREAFTER WITHOUT ACTIVITY IN THE 12 MONTH PERIOD PRIOR. For example, points earned on December 5, 2023 will be eligible to expire on December 6, 2024 and will expire on December 31, 2024 if there was no Activity between December 6, 2023 and December 31, 2024.
IV. ADDITIONAL TERMS
1. Indemnity.
You agree to indemnify and hold PetSmart and its officers, agents, employees and other partners, harmless from any loss, liability, claim or demand, including reasonable attorney's fees, made by any third party due to or arising out of your use of the Treats Rewards Program.
2. Limitation of Liability.
UNDER NO CIRCUMSTANCES SHALL PETSMART OR ITS THIRD PARTIES BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES THAT RESULT FROM YOUR USE OR INABILITY TO USE TREATS REWARDS. THE FOREGOING LIMITATION OF LIABILITY SHALL APPLY IN ANY ACTION, WHETHER IN CONTRACT, TORT OR ANY OTHER CLAIM, EVEN IF AN AUTHORIZED REPRESENTATIVE OF PETSMART HAS BEEN ADVISED OF OR SHOULD HAVE KNOWLEDGE OF THE POSSIBILITY OF SUCH DAMAGES. BY YOUR USE OF TREATS REWARDS, YOU ACKNOWLEDGE THAT THIS PARAGRAPH SHALL APPLY TO ALL CONTENT, MERCHANDISE AND SERVICES AVAILABLE THROUGH TREATS REWARDS, EXCEPT WHERE THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES IS PROHIBITED BY LAW. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR LIMITATION OF DAMAGES FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE FOREGOING LIMITATIONS MAY NOT APPLY. IN ANY EVENT, UNDER NO CIRCUMSTANCES WILL PETSMART BE LIABLE TO YOU FOR ANY AMOUNT EXCEEDING ONE THOUSAND CANADIAN DOLLARS ($1,000.00).
3. Disclaimer of Warranties.
YOU EXPRESSLY AGREE THAT YOUR USE OF TREATS REWARDS IS AT YOUR SOLE RISK. PETSMART TREAT PROGRAM IS PROVIDED ON AN &'AS IS' AND 'AS AVAILABLE BASIS. PETSMART AND ITS OFFICERS, DIRECTORS AND EMPLOYEES, AS WELL AS ITS THIRD-PARTY AGENTS, CONTRACTORS, DISTRIBUTORS, MERCHANTS OR SPONSORS (COLLECTIVELY, 'THIRD PARTIES'), CAN NOT AND DO NOT WARRANT THAT YOUR USE OF TREATS REWARDS WILL BE UNINTERRUPTED, SECURE OR ERROR-FREE. NEITHER PETSMART NOR ITS THIRD PARTIES HAVE ANY RESPONSIBILITY FOR YOUR ACTION OR INACTION IN CONNECTION WITH TREATS REWARDS OR FOR ANY DAMAGE TO YOUR COMPUTER OR DATA OR ANY OTHER DAMAGE YOU MAY INCUR IN CONNECTION WITH YOUR USE OF TREATS REWARDS. NEITHER PETSMART NOR ITS THIRD PARTIES WARRANT THE ACCURACY, INTEGRITY OR COMPLETENESS OF THE CONTENT PROVIDED IN TREATS REWARDS OR THE PRODUCTS OR SERVICES OFFERED FOR SALE. PETSMART AND ITS THIRD PARTIES SPECIFICALLY DISCLAIM ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF TITLE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. NO ORAL OR WRITTEN INFORMATION OR ADVICE GIVEN BY PETSMART OR ITS THIRD PARTIES SHALL CREATE A WARRANTY, EXCEPT WHERE THE EXCLUSION OR LIMITATION OF CERTAIN WARRANTIES IS PROHIBITED BY LAW.
4. Applicable Law.
The Treats Rewards Program is created and controlled by PetSmart. This Program shall be construed in accordance with the laws of the province of the Ontario Member’s place of residence. Members agree that any claim or action brought pursuant to this Program will be subject to the exclusive jurisdiction of the courts of the province of Ontario. The laws of the Province of Ontario will govern the Program without giving effect to any principles or conflicts of laws.
5. Our Access to Your Account.
In order to improve your experience, to help with fraud identification, and to assist our Customer Care Representatives in resolving issues you may experience with Treats Rewards, we use tools to monitor certain user experience information. This includes: Login information, IP address, data regarding pages visited and ads clicked, specific actions taken on pages visited (e.g. information entered during checkout process), and browser information. You hereby grant PetSmart and its parent, sister, subsidiary or affiliated companies the right to monitor your Treats Rewards account activity. We have the right to take any necessary legal action based on fraud, abuse, or suspicious activity in connection with your account. If you are engaged in such activity, you may be liable for monetary losses, including litigation and/or arbitration costs and damages. This section shall survive the termination of your Treats Rewards account.
